Special Educational Needs and Disability
The Special Educational Needs and Disability Act (SENDA) 2001 amends both the Education Act 1996 and the Disability Discrimination Act 1995; applies to pre and post 16 education; makes it illegal to treat a disabled person less favourably than a non-disabled person for reasons related to his/her disability, without justification; and requires institutions to make reasonable adjustments to ensure that a disabled student is not placed at a substantial disadvantage
N.B. HE and FE institutions and Youth Services are covered by SENDA. Other providers of services including training providers and Connexions Services are covered by Part 3 of DDA, which has similar requirements and makes it illegal to discriminate against a disabled person for a reason relating to their disability.
